利用規約

本利用規約（以下「本規約」）は、keensense（以下「当サービス」）が提供するウェブサイト、自然空間コンテンツ、リアルタイム通信機能、Room Pro、および商用利用ライセンス（以下「本機能群」）の利用条件を定めるものです。利用者は、本機能群の利用を開始した時点で、本規約に同意したものとみなされます。

第1条（適用）

本規約は、当サービスのすべての利用者（無料での閲覧・同席利用者、Room Pro 契約者、および店舗・商用利用ライセンス契約者を含みます）に適用されます。

第2条（空間・部屋（ルーム）の利用）

  1. 利用者は、当サービス上で提供される部屋（ルーム）およびカスタムURLを利用して、他者と同席し、自然の景観や環境音、チャット、音声通話、同期タイマー等を共有することができます。
  2. ご家庭や個人での閲覧・鑑賞・同席利用は原則として無料です。店舗・施設等の商業空間での上映は、正規の商用利用ライセンス契約が必要です。

第3条（部屋名の作成・利用および禁止事項）

利用者は、カスタム部屋名の作成、取得、または利用にあたり、以下のいずれかに該当する行為を行ってはなりません。

  1. 実在する第三者（著名人、芸能人、スポーツ選手、政治家、企業、法人、団体等を含む）になりすます行為、または第三者本人もしくは公式であると誤認・混同させる行為
  2. 第三者の商標権、著作権、肖像権、パブリシティ権、プライバシー権、名誉、信用等の正当な権利を侵害する名称を使用する行為
  3. 詐欺的、脅迫的、差別的、猥褻、反社会的、その他公序良俗に反する単語や表現を部屋名に用いる行為
  4. システムの予約語（公式運営、システム管理、技術的基幹用語等）を不当に偽装、回避、または占有しようとする行為
  5. 転売、スクワッティング（不当な先取り・買い占め）、または第三者の利用妨害を主たる目的として部屋名を確保・占有する行為
  6. その他、当サービスの静謐で健全な運営趣旨に照らして不適切であると運営者が客観的に判断する行為

第4条（規約違反に対する措置・管理者の権限）

  1. 利用者が前条の禁止事項に違反した場合、または当サービスの運営上著しい支障があると客観的に判断された場合、運営者は事前の通知や催告を行うことなく、以下の措置を講じることができるものとします。
    • 該当する部屋名・カスタムURLの強制変更、初期化、または一般解放
    • 設定された合言葉（パスコード）の強制解除またはリセット
    • 該当部屋に対する Pro 機能（Room Pro）の利用停止または契約の解除
    • 当該利用者による当サービスへの接続・アクセスの制限
  2. 前項に基づく措置によって利用者に不利益が生じた場合であっても、運営者は故意または重過失がある場合を除き責任を負いません。また、Pro 契約の解除に伴う日割り返金は行われません（特定商取引法に基づく7日間の返金保証の対象となる初期契約時を除きます）。

第5条（有料プランおよび決済）

Room Pro および店舗・商用利用ライセンスの料金、お支払い方法、更新、解約、および返金条件については、特定商取引法に基づく表記および各案内ページに定めるところによります。

第6条（免責事項）

  1. 当サービスは、自然の景観をリアルタイムに描画・配信する性質上、利用者の端末環境、ブラウザの仕様、ネットワーク回線状況によって表示や動作に差異が生じる場合があります。
  2. 運営者は、天災、通信回線の障害、外部クラウドインフラの停止等の不可抗力に起因するサービスの中断や停止について、合理的な範囲を超えて責任を負うものではありません。

第7条（規約の変更）

運営者は、必要に応じて本規約を変更できるものとします。変更後の規約は、当サービス上に掲示された時点から効力を生じるものとします。

第8条（準拠法・管轄裁判所）

本規約の解釈および適用は日本法に準拠し、本サービスに関して紛争が生じた場合は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") govern your use of the keensense website, procedural natural scenery, real-time shared spaces, Room Pro, and commercial display licenses (collectively, the "Service"). By using the Service, you agree to these Terms.

Section 1 (Scope)

These Terms apply to all users of the Service, including free personal visitors, Room Pro subscribers, and commercial license holders.

Section 2 (Rooms and Shared Spaces)

  1. Users may create and join rooms using custom URLs to share ambient scenes, audio, text chat, voice communication, and synced timers with others.
  2. Personal and home viewing is free of charge. Displaying the Service in commercial premises (shops, clinics, salons, offices, etc.) requires an authorized commercial display license.

Section 3 (Room Names and Prohibited Conduct)

When selecting, creating, or using a room name or custom URL, you agree not to engage in any of the following:

  1. Impersonating any third party (including public figures, celebrities, athletes, politicians, corporations, or organizations), or creating a misleading impression of official affiliation.
  2. Using names that infringe upon the trademark, copyright, publicity, privacy, or other legal rights of any third party.
  3. Using room names that are fraudulent, threatening, defamatory, discriminatory, obscene, or contrary to public order and decency.
  4. Circumventing or attempting to spoof system-reserved names (administrative, platform, or routing keywords).
  5. Registering or holding room names primarily for squatting, resale, or preventing legitimate access by others.
  6. Any other conduct that the operator reasonably determines to disrupt the calm and constructive operation of the Service.

Section 4 (Enforcement and Operator Rights)

  1. If a room name or user activity violates Section 3 or poses a disruption to the Service, the operator reserves the right to take any of the following measures without prior notice:
    • Reassigning, resetting, or releasing the custom room URL.
    • Clearing or resetting any room passcode.
    • Revoking or canceling Room Pro features or subscriptions associated with the room.
    • Restricting or blocking access to the Service.
  2. The operator shall not be liable for losses resulting from enforcement actions taken under this Section. Canceled subscriptions are non-refundable on a pro-rata basis, except under the 7-day money-back guarantee outlined in our Legal Notice.

Section 5 (Paid Plans and Billing)

Pricing, payment methods, automatic renewals, cancellations, and refund policies for Room Pro and Commercial Licenses are governed by our Legal Notice (Specified Commercial Transactions Act).

Section 6 (Disclaimer of Warranties)

  1. Because scenery is generated in real time, rendering performance may vary depending on device capabilities, browser versions, and network conditions.
  2. The operator is not liable for temporary service interruptions caused by natural disasters, telecommunication failures, or external cloud infrastructure outages beyond reasonable control.

Section 7 (Changes to Terms)

The operator may update these Terms as necessary. Updated Terms become effective upon being published on the Service.

Section 8 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
